Proposed new series of Australian Design Rule 81 to implement the New Vehicle Efficiency Standard

In May 2024, the New Vehicle Efficiency Standard Act 2024 (NVES Act) received Royal Assent after the passage of legislation in the Australian Parliament. The NVES Act will commence on 1 January 2025.

A new series of Australian Design Rule 81 (ADR 81) is required to implement the New Vehicle Efficiency Standard.

Why we want your input

As part of implementing the NVES, a new series of ADR 81 is required to mandate a CO2 test for vehicles between 3.5 and 4.5 tonnes GVM. This will enable utes and SUVs between 3.5 and 4.5 tonnes GVM to be included in the NVES. We are seeking your input on the design to help inform the new series of ADR 81.

The Issue

In May 2024, the New Vehicle Efficiency Standard Act 2024 (NVES Act) received Royal Assent after the passage of legislation in the Australian Parliament. The NVES Act, commencing on 1 January 2025, uses the CO2 numbers entered for each vehicle on the Register of Approved Vehicles (RAV) to determine whether a regulated entity is compliant. This CO2 number is determined in accordance with ADR 81.

The NVES applies to new vehicles up to 4.5 tonnes GVM, however the current ADR for measuring CO2 emissions (ADR 81/02) only applies to vehicles up to 3.5 tonnes GVM.

The Government recently determined by legislative instrument to exempt vehicles that cannot practically comply with the NVES until 2029, unless and until a CO2 test applies to these vehicles.

A new series of ADR 81 is required to help ensure certain vehicles between 3.5 and 4.5 tonnes are captured within the NVES, as soon as practically possible, to meet the objects of the NVES Act (outlined in s 3).

The new series of ADR 81 will support the implementation of the NVES by:

  • specifying a CO2 test for certain vehicles with a GVM between 3.5 and 4.5 tonnes GVM; and
  • specifying a conversion procedure to enable vehicles complying with stricter ‘Euro 6d’ noxious emission standards adopted in ADR 79/05 to report an equivalent CO2 value for the NVES.

Publication of submissions
