Consultation on reasonable connection and supply requests for statutory infrastructure providers

What will be the outcome of this consultation?

Your submission will be used to assist the Government in considering whether a Ministerial determination is necessary at this point, and if so, the content of the proposed instrument.

The Issue

We are seeking your views on proposed guidance for statutory infrastructure providers (SIPs) on reasonable requests for connection and supply.

Under the Telecommunications Act 1997, NBN Co and other designated SIPs are required to connect premises and supply wholesale services to carriage service providers (CSPs) within individual service areas.

The legislation allows the Minister for Communications, Cyber Safety and the Arts to provide guidance on what should be considered a 'reasonabl0pe request' for connection and supply. Similar guidance has historically been provided under the Universal Service Obligation (USO) in relation to basic telephone services.

The draft Ministerial determination we have released for consultation would set out a consistent baseline for requests to connect premises and/or supply wholesale services under the SIP regime.

Your feedback is important in considering whether a Ministerial determination is necessary, and if so, the content of the proposed instrument.
