Your comments will be considered in finalising the proposed draft exemption instrument. The Issue
The Government is seeking comments on a draft legislative instrument that will exempt some types of networks from statutory infrastructure provider (SIP) obligations.
The new SIP regime (in Part 19 of the Telecommunications Act 1997) is designed to provide all people in Australia with access to modern broadband services. Generally NBN Co or other carriers contracted to provide broadband in new developments will become SIPs. The proposed exemptions will allow other carriers, contracted to provide only fixed or mobile voice services or some transitional hybrid fibre-coaxial services in an area, to do this where required without becoming SIPs.
Comments are requested by Friday, 19 June 2020.
A copy of the instrument and the associated explanatory statement is located at Telecommunications (Statutory Infrastructure Providers—Exempt Real Estate Development Projects and Building Redevelopment Projects) Determination (No.1) 2020.
