Amendments to LBN Co and Telstra SIP nominated service area declarations

The Issue

The Minister for Communications, Urban Infrastructure, Cities and the Arts, the Hon Paul Fletcher MP, is considering amending two declarations to correct the boundaries of two statutory infrastructure provider (SIP) areas.

Under the SIP regime, a carrier that has installed telecommunications network infrastructure in a real estate or building development project under a contract must declare the project area is a 'nominated service area'. This means that the carrier becomes the SIP for the project area and must connect premises and supply wholesale broadband services on reasonable request.

Two such declarations, relating to an LBN Co development in Kogarah, NSW and a Telstra development in Peregian Spring, QLD, contain minor errors in the geographical coordinates for their boundaries.

The Telecommunications Act 1997 provides that the Minister may vary such a declaration made by a carrier. The proposed variation instruments would amend the declarations to ensure the boundaries of the SIP nominated service areas match the boundaries of the networks deployed by these carriers.

While the variations are minor, the Act requires public consultation.

Please note that the variation instruments are administrative and not legislative in nature. They will not be registered on the Federal Register of Legislation. Instead, if signed, they will be published by the ACMA on its SIP register.

Copies of the two variation instruments are provided below. Copies of mapping files showing the current and proposed network boundaries can be provided on request to interested parties.

With regard to the LBN Co variation, the development on Stanley Street will continue to be an LBN Co SIP nominated service area under the name Premiere.
