The Australian Government is enhancing legal aid services to Norfolk Island to help those
eligible in the local community to have access to appropriate legal support and advice for free.
It is recognised that higher costs of living can make it harder for some in the community to
access essential legal services.
The changes include measures to make it easier and more attractive for local lawyers to
undertake legal aid work.
The Government has also updated the means test for access to Norfolk Island’s legal aid
scheme, easing both income and asset requirements in recognition of the current economic
environment.
Legal aid services are a key part of supporting all Australian citizens to equitable access to the
legal services they need, regardless of their financial position.
Under the Guidelines, eligible applicants who meet the means test requirements may access
legal services for criminal charges – including traffic offences, such as drink driving – and family
law matters, free of charge, with the Australian Government covering all legal costs.
The Norfolk Island Law Association and other stakeholders were consulted in the updating of
the legal aid scheme. The changes to the Guidelines are now in effect (from 1 April 2024). The
operation of the scheme will continue to be monitored and reviewed as needed.
