The Issue

The Department of Infrastructure, Transport, Regional Development and Communications is seeking comments on a proposed update to the Telecommunications in New Developments (TIND) policy.

Since the release of the 2015 TIND policy, a lot has changed in the way telecommunications infrastructure is delivered in new developments. The National Broadband Network (NBN) rollout will also be completed in 2020 and new statutory infrastructure provider (SIP) legislation is proposed.

In light of these changes, we have been reviewing the TIND policy so it continues to provide people moving into new developments with timely access to telecommunications infrastructure.

The proposals follow an initial round of public consultation that concluded in early 2020.

The Government considers that the main features of the TIND policy remain appropriate, but changes can be made to improve the market’s operation and simplify the policy going forward.

Our objective is to complete the review and have a revised policy in place in place as soon as practicable, in anticipation of the completion of the NBN and proposed SIP rules.

This document sets out a proposed update to the Australian Government’s policy on the provision of telecommunications in new developments that took effect on 1 March 2015. The Government is seeking comments on the proposed update by Monday, 8 June 2020. The draft was re-issued on 28 April to improve accessibility but without any changes to content.

Outcome

The Minister for Communications, Cyber Safety and the Arts released a revised Telecommunications in New Developments policy on 1 September 2020.

Submissions on the proposed changes to the policy will be uploaded here shortly.

The Regulation Impact Statement will be available on the website of the Office of Best Practice Regulation.
