Invitation to identify the owner of certain land

To enable the future expansion of Melbourne Airport, the Commonwealth Government is preparing to commence a process for the acquisition of the land comprised in Certificate of Title Volume 11857 Folio 290, being Lot 1 on Title Plan 962273H.

The Commonwealth Government is seeking to identify the owner of that portion of this land shown on the plan set out below as ‘Bassett Road (Unconstructed Two Parts)’. The owner or holder of an interest in relation to that portion, or anyone with information enabling the owner to be identified, is requested to contact the Commonwealth on or before 1 June 2018.

The above notice was published on 5 May 2018 in the Age, the Australian and the Herald Sun newspapers. Several notices were also placed on the unconstructed portions of Bassett Road located on the map.

Why is the Commonwealth trying to identify the owner?

The Commonwealth Government is seeking to identify the owner of the land as part of a process to acquire land for the expansion of the Melbourne Airport.

Why is the land required?

Melbourne Airport’s expansion has been in planning for a number of years, with the proposal for a third runway (and ultimately a fourth runway) a feature of Melbourne Airport’s Master Plans since privatisation of the Airport. The Airport’s growth (including through potential development of a new third runway) is critical to cater for projected future passenger growth, expected to double to 64 million passengers per year by 2033. A third runway will support the national economy, create jobs and support growth in the state.

Who owns the land?

The land is registered to John Pascoe Fawkner who is now deceased, with Mr Fawkner’s deed of grant dated December 1850—more than 150 years ago. The owner of the land is therefore not known.

Who owns the surrounding parcels of land?

Melbourne Airport own the parcels of land adjacent to the land.

Where is the land located?

The land is located near Bassett Road, Melbourne Airport VIC 3045, as shown on the above notice. The land is approximately 6770m2.

What is currently on the land?

The land is currently vacant consisting of dirt tracks and grass.

What happens if an owner is (or cannot) be identified?

The Commonwealth proposes to proceed to acquire the land by compulsory process under the Lands Acquisition Act 1989 (LA Act). This process can be carried out even if the owner cannot be found.

Will the rightful owner be compensated for the land?

If an owner of the land comes forward after the land has been acquired, they will be entitled to claim compensation for the compulsory acquisition in accordance with provisions of the Lands Acquisitions Act 1989.

Who should I contact in relation to ownership of the land?

Anyone who has information on the owner of the land should contact the department by 1 June 2018, by email at Airport.Ownership@infrastructure.gov.au or by post at Airports Branch, Department of Infrastructure, Regional Development and Cities, GPO Box 594, CANBERRA ACT 2601.

What do I need to provide the department if I believe I am the owner of the land?

Noting the circumstances and the passage of time, determining the rightful owner may be complicated. Someone who believes they are the owner of the land, will need to provide evidence that they are the owner. In the first instance, the department requests individuals provide the following information:

  • Full name.
  • Contact information including address, phone number and email.
  • Summary of claim of ownership or interest in the land.
  • Evidence to support the claim such as wills, historical birth certificates, or other supporting documentation.
  • Any other information which may assist to confirm the claim.

In accordance with the Privacy Act 1988, the department is collecting personal information, and may disclose this information to other Commonwealth agencies, for the purposes of contacting:

  • the owner or holder of an interest in the land comprised in Certificate of Title Volume 11857 Folio 290, being Lot 1 on Title Plan 962273H; or
  • anyone with information enabling the owner to be identified.

The department will take all reasonable steps to ensure your personal information is stored securely. Your personal information may be used by the department or other Commonwealth agencies to make further contact with you but will not be disclosed to any other third parties except as required by law.
